JEMPOL: The magistrate's court here today ordered an underage boy who had raped his younger sister last year, leading to her giving birth last month, to be sent to the Henry Gurney School in Melaka for three years.
Magistrate Norshazwani Ishak made the decision after going through a social behaviour report presented by the Welfare Department on the 15-year-old.
The boy had been charged two counts of incest under Section 376B(1) of the Penal Code.
On the first count, the teen was charged with committing incest between 11pm and midnight between June 21 and 30, 2022, at a house in Jempol.
On the second count, he was alleged to have repeated the offence between Sept 1 and 10, the same year.
Under that particular section of the Penal Code, the accused is liable to a jail sentence of between 10 and 30 years, and whipping.
According to the facts of the case, the accused's sister, who is 14, gave birth to a healthy baby boy last month.
A medical officer and staff from a health clinic who went to the girl's house found her lying on a bed and the baby with his umbilical cord still attached lying in a basin.
The medical officer then cut the umbilical cord and brought both the teen and her son to the health clinic for treatment, before referring them to a hospital.
The case is being handled by deputy public prosecutor Ahmad Loqman Hakim Ahmad Khairie while the accused is unrepresented.
