KUALA LUMPUR: An ice truck driver whose vehicle struck a van, killing nine people near Tapah in 2016 was sentenced to four years in jail for reckless driving.

This is after Muhammad Eizat Hazmi, 27, failed in his application to appeal his conviction and sentence meted out by the magistrate's court recently.

Ipoh High Court judicial commissioner Moses Susayan when dismissing the appeal said the learned magistrate had not erred in convicting the appellant under Section 41(1) of the Road Transport Act.

"The court finds that the prosecution has successfully proven its case beyond a reasonable doubt.

"The evidence presented overwhelmingly supports the charge that the appellant drove in a manner dangerous to the public, leading to the death of multiple individuals.

"I find no merit in the appeal.

I dismiss the appeal and affirm the conviction and sentence," he said in his full judgement made available at the judiciary department website last week.

The court also upheld the RM12,000 fine in default eight months' imprisonment against the appellant.

On Jan 19, 2018, Muhammad Eizat pleaded not guilty to the offence which led to the death of the van driver and eight passengers, aged between 55 and 82, at Km45 of Jalan Ipoh-Teluk Intan near here at 6.45am on Oct 28, 2017.

The eight passengers killed were friends on their way to a vegetable farm when the accident occurred.
