KUALA LUMPUR: Pas has decided not to appeal the Election Court's decision to annul the party's win in the Kemaman parliamentary constituency in the last 15th General Election (GE15) last year, said its secretary-general Datuk Seri Takiyuddin Hassan.
"Pas has decided not to file any appeal against the decision of the Kuala Terengganu Election Court on Sept 26, which allowed the Barisan Nasional's petition against Che Alias Hamid's win.
"This decision effectively nullifies Pas' victory in the 15th General Election on Nov 19, 2022," he said.
Takiyuddin said that Pas now will wait for the next step based on the Election Commission (EC) decision on the matter.
The Terengganu Election Court had annulled Che Alias' victory in Kemaman in GE15 after judge Datuk Anselm Charles Fernandis said the petitioner, voter Wan Mohamad Hisham Wan Abdul Jalil, succeeded in proving that corruption had taken place with the aim of influencing voters in GE15.
Earlier, on Feb 12, Wan Hisham's petition was struck out after the High Court accepted the preliminary objections raised by the respondents in the case.
However, the Federal Court, on May 2 overturned the lower court's decision and ordered the case to be sent back to the High Court for full hearing of the merits of the petition.
On Nov 19, Che Alias had been declared the winner with a 65,714-vote majority, beating BN's Datuk Seri Ahmad Said, PKR's Hasuni Sudin and Pejuang's Rosli Ab Ghani.
This is the second parliamentary seat in Terengganu where GE15 results were annulled.
On June 27, the court had also annulled the Kuala Terengganu parliamentary seat result for the same reason.
That led to a by-election held simultaneously with the elections in six states on Aug 12. Pas, however, retained the seat.
The two election court decisions and the reason give for the annulments, however, have led to calls by political analysts for a review of the GE15 results in Terengganu as a whole.
