KUALA LUMPUR: An appeal has been filed by the prosecution to increase the 12-year jail sentence and RM210 million fine handed down to Datuk Seri Najib Razak over the misappropriation of RM42 million from SRC International Sdn Bhd.

Head of the Appeals Unit in the Attorney-General's Chambers (AGC) appellate and trial division, Datuk Mohd Dusuki Mokhtar confirmed that the notice of appeal was filed via e-filing on Aug 7.

"We (prosecution) filed the notice of appeal against the whole sentence and fine imposed by the High Court," he said.

Today, he said was the last day for the prosecution and defence to file their appeals since they have 14 days to file it after the verdict was pronounced on July 28.

On July 30, the former prime minister had filed a notice of appeal against his conviction and sentence meted out by High Court judge Mohd Nazlan Mohd Ghazali on seven charges of criminal breach of trust (CBT), money-laundering and abuse of position involving RM42 million of SRC International funds.

The Pekan member of parliament was sentenced to 12 years' jail and fined RM210 million.

For the three criminal breach of trust offences under Section 409 of the Penal Code, Najib was ordered to serve 10 years' jail on each count.

He was also ordered to serve 10 years' jail on each of the three counts of money laundering under Section 4(1)(b) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLATFPUAA).

On the abuse of position charge he was sentenced to 12 years' jail and fined RM210 million.

However, all the sentences were to run concurrently. This means Najib will only serve a total of 12 years' jail.

He would have to serve an additional five years' jail if he fails to pay the fine.

Mohd Nazlan also granted Najib a stay of execution pending his appeal.

He ordered Najib to pay an additional RM1 million in bail to top-up the RM1 million he already paid when he was charged.
