KUALA LUMPUR: Sime Darby Property Bhd was ordered to compensate about RM4.8 million to six bungalow owners for defects in their properties in Bukit Jelutong.

A Free Malaysia Today report stated then High Court judge Datuk Wong Kian Kheong made the ruling after the six had proven their case against the developer on the balance of probabilities last year.

Wong, who is now a Court of Appeal judge also awarded RM560,000 in cost to the plaintiffs and interest at the rate of five per cent calculated until full payment of the judgment sum.

The developer has appealed against the ruling, which is scheduled to be heard at the appellate court on Oct 29 this year.

Wong in his judgment dated Nov 11, last year, said Sime Darby should have sued the main contractor – Kitson Sdn Bhd to seek indemnity or contribution towards damages payable to the plaintiffs.

The six owners filed their lawsuit in 2017 against the developer for the cost of rectification of defects to their units.

The developer in its defence, argued that there were no defects and asserted that any deficiencies had been addressed.

The court in its ruling disagreed with the defence's assertion that the defects were caused by renovations carried out by the buyers.
