BANGI: A woman was in tears as her husband was hauled to the magistrate's court to face a murder charge of their own six-month-old son, due to alleged abuse, last Sunday (April 14).

The teary woman was seen speaking to counsel, Arif Azmi, and she later sat at the public gallery to follow the entire court proceedings.

Her husband, a 25-year-old security guard, was brought into the court compound by several Criminal Investigation Department officers.

Mohamad Aizat Samin, however, showed no emotion when the charge was read out to him before magistrate Nurdiyanah Mohd Nawawi.

He nodded when he was asked if he understood the charge by the court interpreter.

No plea was recorded as murder cases are under the jurisdiction of the High Court.

The charge sheet read that Aizat, had between 8pm on April 14 and 7.40pm on April 15, murdered Muhammad Aysar Wildam Mohamad Aizat at Pangsapuri Baiduri in Bandar Tasik Kesuma in Beranang.

The offence carries a death penalty or imprisonment of not less than 30 years and not more than 40 years.

If the death sentence is not meted out, there will also be not less than 12 strokes of the cane.

Deputy public prosecutor Siti Nur Liyana Mohd Sulaiman did not offer bail.

She asked the court to set a mention date pending chemist, toxicology, forensics and post mortem reports.

Magistrate Nurdinayah did not grant bail and set May 28 for mention.

On Wednesday, Kajang deputy police chief Superintendent Muhamad Nasir Drahman said the father had told the police at 8.52am on Monday that the baby was unconscious.

Nasir said an initial examination found no injuries on the baby's body.

However, a forensic examination by the Kajang Hospital Forensic Department discovered evidence of abuse on the victim's body.

The results confirmed that the baby's injuries were not caused by an accident but by criminal actions.

The father was detained in the department's compound at 11.30pm the same day to be probed for murder.

He tested positive for methamphetamine.

Harian Metro reported that the baby was believed to have been beaten, swaddled, had his head hit on the sofa, apart from his mouth being stuffed with a piece of cloth and left lying face down in a dark room without supervision before he was found dead.

The incident occurred when the wife and their eldest child aged two had gone to their in-law's house while the husband was left alone with the baby in the apartment unit.
