PETALING JAYA: A father and his two sons were charged today in the Sessions Court with the death of an Indian clerk, whose lifeless body was discovered in a sack two weeks prior.

Businessman Datuk V Nanta Kumar, 51, along with his sons Miren Ram, 24, and Krithik Ram, 22, entered not guilty pleas as the charges were read before Judge Faiz Dziyauddin.

The trio, accompanied by another person who remains at large, were alleged to have intentionally inflicted bodily harm that led to the death of A Vinayagamoorthy,41.

The incident is said to have occurred at a scrap metal site in Jalan Bersatu BS 5, Taman Bukit Serdang, Seri Kembangan, at about 1.30pm on Aug 4.

The charges have been framed under Section 304(a) of the Penal Code for culpable homicide not amounting to murder and are combined with Section 34 of the Penal Code.

Conviction under these sections carries a maximum prison sentence of 30 years and a fine if convicted.

Following their plea of not guilty, Deputy Public Prosecutor Ahmad Zuhaini Mahamad Amin did not propose bail due to the nature of the charges.

However, the defence lawyer, Datuk Suraj Singh, applied for bail on the grounds that all his three clients had health issues.

"Nanta Kumar suffers from diabetes and spine disease. Miren Ram has asthma, and Krithik Ram needs treatment after an accident recently.

"Although It is a non-bailable offence, the court can use its discretion to grant a bail," he said.

The court then allowed all the accused to be bailed at RM10,000 each with one surety, in addition to the additional condition of submitting their passports to the court and reporting to the nearest police station every month.

The court set Sept 19 for mention.

The media reported that the body of a foreign man was found in a sack at a scrap metal site in Taman Bukit Serdang, believed to have been beaten to death.

Thirteen people, including three women and the victim's employer, were detained to assist in the investigation.
