SELAYANG: Tears ran down the cheeks of a 24-year-old mother as she was charged at the Sessions Court, here, with neglect of her 5-year-old son who died after falling from the 16th floor of a condominium.

The woman, who could not be identified, pleaded not guilty to the charge before judge Nor Rajiah Mat Zin.

According to the charge sheet, the woman, as the person having the care of the child, had neglected the boy, causing him to suffer physical injuries.

The offence was allegedly committed at a condominium at Jalan Lebuh Raya Selayang-Kepong, Gombak, between 9.45am and 10.48am on Nov 17.

The charge framed under Section 31(1)(a) of the Child Act 2001, carries a maximum fine of RM50,000 or a maximum 20 years jail, or both upon conviction.

Deputy public prosecutor Nur Shasha Hidayah Nor Azahar proposed a RM15,000 bail to be imposed on the accused as well as additional conditions deemed fit by the court.

The mother of two cried as she pleaded for a lower bail as she has a 4-year-old child she needed to care for and that she has not recovered from the loss of her son.

"I am a housewife and I cannot afford to pay the bail... I still have another child to look after. My health is unstable after I lost my son," she said, adding that her husband works as a food delivery rider.

The accused was unrepresented.

Nor Rajiah allowed the accused RM8,000 bail with one surety and for her to report to the police station once a month.

The case will come up for mention on Jan 13, next year.

It was reported that on Nov 17, a 5-year old boy died after falling from the 16th floor of a condominium unit in Batu Caves, Gombak, here.

The tragic incident took place at about 10.30am when the boy's aunt who was inside the house suddenly realised her nephew was not in his room.

Selangor Criminal Investigation Department (CID) chief SAC Nik Ezanee Mohd Faisal said preliminary investigations indicated that the victim was believed to have been playing and climbed onto a bed by the window which did not have a grille.

He said it was believed that the victim fell out of the window.
